Abstract

Supreme Court Circular Letter (SEMA) Number 3 of 2023 refines SEMA Number 1 of 2022 by allowing divorce on grounds of continuous disputes only where reconciliation is hopeless and the spouses have lived apart for at least six months, unless domestic violence is proven. Since the circular does not define domestic violence, its interpretation and proof determine how widely divorce is opened. This library research uses a conceptual approach and content analysis of SEMA Number 3 of 2023, the Compilation of Islamic Law, and Law Number 23 of 2004 on the Elimination of Domestic Violence. The results show that domestic violence causes the continuous disputes referred to in Article 116 letter f of the Compilation; that it covers physical, psychological, and sexual violence as well as household neglect; and that such divorce cases should ideally be preceded by a criminal judgment, which then serves as evidence before the Religious Court.
